EUROPEAN STANDARD? - On 9 July 2015, the European Parliament might destroy photography!

" Das Europäische Parlament […] vertritt die Auffassung, dass die gewerbliche Nutzung von Fotografien, Videomaterial oder anderen Abbildungen von Werken, die dauerhaft an physischen öffentlichen Orten platziert sind, immer an die vorherige Einwilligung der Urheber oder sonstigen Bevollmächtigten geknüpft sein sollte"

Der ursprüngliche Text lautete:

"Das Europäische Parlament […] fordert den Gesetzgeber der EU auf, sicherzustellen, dass die Nutzung von Fotografien, Videomaterial oder anderen Abbildungen von Werken, die dauerhaft an öffentlichen Orten platziert sind, gestattet ist"

Der ursprüngliche Bericht der Europaabgeordneten Julia Reda hatte eine Harmonisierung in Form einer einheitlichen Panoramafreiheit vorgesehen. In Umkehrung dieses Zieles, wurde durch den Änderungsantrag 421 des französischen Abgeordneten Jean-Marie Cavada, mit nahezu 3/4-Mehrheit, eine allgemeine Einschränkung der Panoramafreiheit vom Rechtsausschuss vorgesehen. "The European Parliament [...] believes that the commercial exploitation of photographs, video material or other images of works that are permanently placed on physical public places, should always be subject to the prior consent of the author or other agent"

The original text was:

" The European Parliament [...] calls on the EU legislator to ensure that the use of photographs, video material or other images of works that are permanently placed in public places is allowed"

The original report of MEPs Julia Reda had provided an approximation on a uniform panoramic freedom. By Amendment 421 of the French parliamentarians Jean-Marie Cavada, a reversal of this objective was provided, with close to 3/4 majority by the Legal Committee - a general limitation of the panorama freedom!
