I'm surprised to see a ladder there, would have thought some regulation would have required that it be removed.

Well, if it were abandoned _now_ there would be a lot of remediation required! But this is one of those "legacy costs"; it was abandoned decades ago and now we just have to deal with it as it was left. The existence of old rotten ladders and such is one reason for the campaigns to "stay out and stay alive" on abandoned mines. The BLM is also filling in those close to urban areas (e.g., around Reno), but they haven't gotten around to remote sites such as this, and probably won't for a while.

I've seen open, abandoned, mines relatively close to Pahrump -- though BLM does seem to be working fairly steadily to close those up. The wood on the casing for this seemed to be fairly recent (or very well preserved), which is part of why I noticed it.
