How far can you go ?
do you have the right to take it ?
Street art is illegal and outlaw ?
i want to hear your opinium !!!

Street art is.
What is different in street art compared to street advertising???
Is street advertising not vandalism because companies pay a huge amount for it to be displayed and therefore make it legal????
Even if what is advertised is sometimes brutal or actually not very recommended(such as alcohol or tobacco)?
We could go on forever on the subject...
But Henri, you are bringing up this discussion because of a picture you used from my stream without asking me if it was ok. You just modified it and then posted it in your stream without even mentioning the original source(which I do mention in my tags, by the way).
You seem center the discussion on the legality or illegality of a graffiti which is beyond the point since my point is NOT about graffiti at all.
War is, they say, legal...
Might be legal but to my eyes it is yet another atrocity of the human being and definately not moral at all.
Think about that!

Is this yours ?

Is this yours ?
i did let you know i used the same street art but i did mention your name because you did not make it !!
PLEASE TRY TO UNDERSTAND WHAT I DO HERE IS NOTHING BAD

And I do refer to where and how I found it, which seems natural to me.
You do not even try to understand what I am saying, it seems...
Or maybe I am being very obscure in my points...
Could be.
Josie Soho® says:
henri, if you in fact used Animar's photo and created a derivative with no Creative Commons license or permission from Animar- you have created a copyright violation.
shooting the graffiti and using it yourself is a separate issue unrelated to the dialog i see you and Animar having.
i hope there can be a friendly resolution here.
Henri Bankspro replies:
yes it looks almost the same as her picture but i painted that myself and with showing this similarity i got a war going on ,actually i used many words more words than i have and i am not coming true.
there was no copyright violation only a similarity .
Josie Soho® replies:
you went to seville and took a picture or you looked at Animar's picture and made your own in PS or some other program??
Henri Bankspro replies:
Josie Soho® replies:
If I make this pic when i know the artist lives inside how much is it mine?
Henri Bankspro replies:
Josie Soho® replies:
but since i went there with the knowledge that the artist lives inside i feel i am obligated to credit him when possible. if people resort to displaying their art on the street, on their house or on the internet and they are known they should be credited.
derivs and spinoffs have legalities and moral issues for artists with conscience.
have a great afternoon henri.
mad.melon replies:
i took the pic, but if someone is talented enough to make such stencil at home and spray paint across the wall and then take a photograph of it it's ok. it's not copyrighted. and of course someone else thought of it first but it's stencil... so we are discussing using of an idea and this idea was sprayed/stenciled on a wall, right? we are not discussing using Amimar's picture, but only IDEA for the stencil, right? or am i lost?
sigh... i really don't know how to explain it better but if you are spraying your idea on the wall with no copyrights it seems free to use...

also : isn't there a copyright for the streetartist who made this ? well this is going too far ...
and it's not the point . the copyright law in germany says that you are allowed to use
the picture of somebody else if you change it to a certain degree ( expressed in a percentage
number .. which i don't know by heart ) / animar based on this law there is nothing wrong in what henry did ..
maybe he should have told you before , but he didn't want to do you any harm and he mentioned
you as being the original photographer ( as he told me )
*~Amimar~* replies:
Things are now difficult to trace since Mr Banks has removed completely all the comments he has originally made on my guestbook and also on the picture.
I will reserve my opinion on this individual who seems to not only modify people´s picture without asking but also reality.
He has now tagged the pics he modified, without even telling me had done so it would make me look like a complete stupid, which I am not.
This whole issue has brought to my attention a few things and I am now going to take decisions over my uploading and the availability of my pictures...
Henri Bankspro replies:
i dont want to put some gasoline on the fire .and why i removed my comments ? because i am not a man of words and there were too many words who did not belong there
i dont want to say more words i dont want to make trouble i just want to make art thats it
and when you show in yourself you want the same.

We both appear as stubborn (I admit I am as hell when I think I am right) and defend our views with our reasonnings.
Yours did make sense to me, but hey, thanks for the rose anyway!
