Ipernity TOS

Can somebody explain me in easy words, what exactly Inpernity can do with our stuff regarding to their TOS?

5.9 By submitting, posting or displaying Content on or through the Service, you grant Ipernity a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such Content through the Service, including RSS or other content feeds offered the Service, and other Ipernity services.

5.10 In addition, by submitting, posting or displaying Content which is intended to be available to the general public, you grant Ipernity a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such Content for the purpose of displaying, distributing and promoting Ipernity services.

Stewie just pointed it out to me and I'm a bit lost

Ok -RSS is obvious,because RSS is a content service, which will bring the docs into the web outside this plattform.

5.10 is a little bit strange. Lets ask the guys from Ipernity.

5.10 means IMO that they can do anything with your image if they use it for promoting Ipernity without asking you or paying. I think it doesn't mean that they can sell your images, or so.

So basically here they can make money out of it in the way that they can gain new users...

5.9 I would interpret basically as the right to offer you the service of showing your posts to others ;-)

But it might really be good to ask Ipernity guys. Esp. 5.10 looks overcomplicated and partially doubled with 5.9 to me. BTW, what does the French version say?

I was wondering about the French version too, but my French is way too rusty.
I helped them working on the English / German membership rules translation and had to look up the French one from time to time. Some things just didn't make sense.
Might be the same here.

Hmm. I am a little bit concerned about 5.10. , not sure that I like it. Hmm. theoretically they can do anything with the pics if it has just something to do with ipernity.

5.10: maybe covers public access via API. Doesn't eg. Netvibes allow streams of certain tags, groups, users? I don't know if this is done via API access, but i don't think it's done via RSS.

according to the french version, i underdtand that you allow them to show anywhere your stuffs in the ipernity(5.9) and allow them to use any of your stuff for their promotion,... also only in the ipernity (5.10)

5.9 and 5.10 are just there to prevent people from claiming money for putting their pictures on Ipernity's main page [= internationally promoting Ipernity services].

I'm afraid it's the same everywhere. I know a contact from flickr whose photos were taken by **oo without asking him (But I don't know the details, he didn't want to tell). From then on he didn't use tags any more and made all photos only visible for friends and uploaded them in a small version.

Blue, you can be sure, that it is the same everywhere - compare the tos of flickr/yahoo and this place. one problem is, that most people don't or didn't read them, me included. i was upset when i've read, that i had given a royalty-free-license to flickr/yahoo. when i took notice of it - last weekend - when i was checking out this place - and the rules in the tos are similar.

Especially non-exclusive means that you can still sell your stuff to someone else.
And anything that goes beyond promoting Ipernity is not part of the contract, therefore not allowed. They can't resell your photos or use them as stock photography to gain money.

IMHO: nothing to worry about.

Flickr-Stewart hat sich hinterher dafuer entschuldigt, und sie haben es dann geaendert, und nur noch Fotos mit CC Lizenz dafuer genommen.

Soweit ich mich erinnere, hat Yahoo fuer wii geworben, und die Fotos dafuer wurden aus Flickr gezogen. Und zwar alle Fotos, die wii als Tag hatten - ohne Ruecksicht auf Copyright oder CC Lizenz.

Das hat mich damals dazu veranlasst, meine Bilder aus der API Suche bei anderen Webseiten UND bei Flickr selber zu nehmen.

Das Recht am Bild liegt sowieso beim Urheber. Sofern man seine Bilder mit vollem Copyright ausstattet, können solche Bedingeungen in den TOS es nicht aushebeln. Aber es muss natürlich irgendwo festgehalten werden,

I didn't knew about this wii story before, Anyway, it's best not to upload photos bigger then 800px largest side. If you claim your copyright in the description or by choosing the right license-type, the TOS can't ignore this setting, because you are the author, and you decide about the rights on your work.

Zwischendurch sind immer wieder Bilder im Originalformat da. Naja, muss ich halt fie Festplatte nach denen absuchen ;)

Ja, das wuerde ich auch gerne so machen, wenn mich die Kroete beim ruebrladen von flickr die Groesse aussuchen lassen wuerde. Ansonsten sind die neuen eh im Kleinformat oben ;)
